TERMS AND CONDITIONS – HARLEM GARDEN

Welcome to Harlem Garden. These Terms and Conditions govern the purchase of products and services from our shop located at 3546 Broadway (between 145th and 146th), New York, NY 10031, through our website, or via phone at (646) 983-9499. By placing an order, you agree to be bound by the following terms:

01. THE ORDER

  • Product Representation: Flowers are natural products. While we strive to match the photos on our website, seasonal availability may require substitutions of equal or greater value. The overall style, theme, and color palette will always be maintained.

  • Order Acceptance: An order is considered accepted only once payment is processed and a confirmation is sent. We reserve the right to cancel any order due to lack of stock or delivery constraints.

  • Accuracy: The customer is responsible for providing the correct recipient name, full address (including apartment or suite number), and a valid contact phone number.

02. SHIPMENT AND DELIVERY

  • Delivery Areas: We provide delivery services within Manhattan and specified areas of NYC. Please verify your zip code at checkout.

  • Timed Deliveries: While we do our best to accommodate specific time requests, we cannot guarantee exact delivery times during peak holidays (Valentine’s Day, Mother’s Day, etc.).

  • Recipient Absence: If the recipient is not home, our driver will attempt to:

    1. Leave the arrangement with a neighbor or doorman.

    2. Leave it in a safe, shaded area (weather permitting).

    3. Contact the recipient/sender for instructions.

  • Redelivery: If a delivery cannot be completed due to incorrect information provided by the customer, a redelivery fee may apply.

03. PRICING AND PAYMENT

  • All prices are in USD and are subject to New York State sales tax.

  • Delivery fees are calculated based on the distance from our shop at 3546 Broadway.

  • We accept all major credit cards and digital payments. Full payment is required before the order is dispatched.

04. RETURNS, EXCHANGES, AND COMPLAINTS

  • Perishable Nature: Because flowers are fresh, perishable items, all sales are final.

  • Quality Guarantee: If you are not satisfied with the freshness of your bouquet, you must contact us at (646) 983-9499 within 24 hours of receipt.

  • Resolution: To qualify for a replacement or store credit, we may request a digital photo of the arrangement or the return of the original product. We do not offer refunds for complaints made after the 24-hour window.

  • Order Cancellations: Cancellations must be made at least 24 hours before the scheduled delivery date to receive a full refund. Same-day orders cannot be canceled.

05. CARE INSTRUCTIONS

Harlem Garden is not responsible for the longevity of flowers if they are not cared for properly (e.g., lack of water, exposure to extreme heat or direct sunlight) once they have been delivered in good condition.

06. LIMITATION OF LIABILITY

Harlem Garden’s maximum liability for any order shall not exceed the total amount paid by the customer for that specific transaction.
